A workers compensation board in Pennsylvania has ruled that a lack of transportation is not "largely irrelevant" in determining workers compensation benefits, contrary to the prior ruling of a judge.
A worker was injured on the job and received weekly workers compensation benefits. His former employer filed a modification alleging that a survey found that work was generally available to the man, despite the fact that the only car in the household was used by the man's wife during regular daytime hours. A judge ruled that the lack of transportation was "largely irrelevent" in determining workers compensation. However, a workers compensation board overruled the judge, saying that a lack of transportation effectively prevented the man from finding work.
