A 35-year-old construction worker became trapped in an 18-foot hole after after an accident at the construction site.

The man was working on repairing the hole when his coworker was trying to attach a bucket to a backhoe. The ground then gave way under the weight and the bucket slipped down the hole and trapped the man. Rescue crews worked for nearly two hours to free the man and get him out of the hole. He was transported the hospital to be treated for his injuries.

Pennsylvania coal mine air-packs recalled

Posted on March 16th, 2010 No Comments

A Pennsylvania manufacturer of coal mine air packs recently issued a voluntary recall of their products because of reports that the oxygen starter did not function correctly.

The device is a belt pack that helps recycle exhaled breath in the event of a mining emergency and is designed to provide miners about
one hour of breathable air while they attempt to escape. The air packs have been used during many mining emergencies over the past six years, including during a January explosion at a mine in West Virginia. The sole survivor reported that miners could not get their
devices to work.

If you or a loved one has been injured at your job because of a malfunctioning product or machinery, you may be able to receive
compensation for your losses. Contact the Pennsylvania workers’ compensation lawyers of Lowenthal & Abrams, P.C. at 610-667-7511

$657.5M tentative settlement reached in Ground Zero workers' comp. lawsuit

Posted on March 12th, 2010 No Comments

A tentative settlement has been reached in the cases of almost 11,000 Ground Zero rescue and cleanup workers; up to $657.5 million could be awarded.

The settlement will be awarded based on the individual severity of illnesses and the level of exposure to contaminants at the World Trade Center site. The money would come from a federally financed insurance company with funds of more than $1 billion.

In order for a settlement to take effect, 95 percent of the 11,000 plaintiffs must accept the terms. If 100 percent of the plaintiffs agree to the accord, the settlement would be $657.5 million. The total would shrink to $575 million if only the required 95 percent of plaintiffs agree.

The plaintiffs injuries are mostly respiratory related. The injuries were caused by a toxic mix of contaminants at ground zero and a lack of protective equipment.

OSHA surveys companies to find where most injuries occur

Posted on March 12th, 2010 No Comments

The Occupational Safety and Health Administration have surveyed employers and collected data in order to find companies who have injury and illness reports higher than the national average.

Letters have been sent to the 15,000 workplaces that have the highest rates of injury and illness that resulted in missing one day of work, job transfers or restricting work activities. Officials have said that if your workplace receives a letter, immediate action should be taken to fix the issues. The letters include the data collected by OSHA of their workplace’s injury and illness reports along with OSHA’s standards for their industry. The letter also has advise on how to improve working conditions, including a reminder that OSHA offers free safety and health consultation services for small businesses.

A Pennsylvania construction company was cited after a worked fell 225 feet off a building.

The company, Mariani & Richards Inc., was investigated by the Occupational Safety and Health Administration in August of 2009 after the death of a worker. After the investigation, OSHA found that the company was not providing their workers with necessary fall protection while working on a building in downtown Pittsburgh. They were cited with one willful violation and fined $70,000. This company was cited for the same thing in 2007 but did not take the proper steps to correct the issue.
