Fire destroys Pennsylvania recycling plant

A recycling plant in Plainfield Township, Pennsylvania was destroyed after a fire broke out last week.
There were three employee inside the plant, Nicos Polymer Group, when the fire erupted. Luckily, all three managed to get out of the building without serious injury.
Nearly 200 firefighters responded to the scene in order to fight the flames that consumed the 180,000 square foot steel building. The black smoke rose high in the air and was reportedly seen for miles. The cause of the fire is unknown at this time and remains under investigation.

Bill proposes workers’ comp to firefighters with cancer

A bill that proposes allowing volunteer and career firefighters who develop cancer as the result of their service as a firefighter to receive workers’ compensation benefits is awaiting a signature from Governor Rendell.
The bill, HB 797, was recently passed by both the Pennsylvania House of Representatives and Senate. Governor Rendell received the bill on June 28th, but there is no time limit for him to consider or sign it.
If the governor signs the bill into law, cancer will be listed among other occupational diseases that make firefighters eligible for workers’ compensation.
The bill would require firefighters receiving workers’ compensation to have served continuous firefighting duties for at least four years. In addition, the bill requires that firefighters applying for workers’ compensation have tests and records that they were cancer free before they began their firefighting duties.

Husband of obese N.J. worker awarded worker’s compensation benefits

The husband of an obese New Jersey woman has been awarded worker’s compensation benefits after the woman died of a blood clot that formed in her leg and moved to her lung.
She was working overnight to finish a project when she died. The worker’s compensation claim filed by her husband stated that the clot formed while she was working at her desk.
AT&T stated that the woman was obese because she weighed over 300 pounds and this is what caused her heart to enlarge. She also recently began taking birth control which can increase risk factors.
Blood clots in a person’s leg can occur when a person does not move around for a long period of time. The appellate court decided that since the clot most likely occurred in the overnight hours when she was working, that her husband has ‘sufficient evidence’ for a worker’s compensation claim.
‘Green Lantern’ worker files suit against Warner Bros.

A man who claims that he was seriously injured while working in special effects on the set of the Green Lantern movie has now filed a lawsuit against the studio.
The lawsuit does not have much detail, but it states that the man was injured while working on the movie in Louisiana and it caused him internal and external pain.
Along with the injuries, the man said he also suffered from severe fright, anxiety, shock, and discomfort. The lawsuit was filed Wednesday, but Warner Bros. studios has not commented.

New Pa. workers’ compensation bill to be heard this month

A bill in the Pennsylvania is scheduled to be heard on March 23 and will expand the workers’ compensation coverage to businesses that were previously ineligible.
The bill, HB 440, will expand the Workers’ Compensation Act so that insurers can cover those who are members of a limited liability corporation or partners in a business partnership. The bill has been called a “common sense” bill that many can see the advantages of. This bill will broaden coverage for employees and employers if someone is injured in an event at work.

Heavy machinery falls on man in industrial accident

An industrial accident at a strip mine operation caused one man to be trapped underneath a piece of heavy machinery and suffer serious injuries.
The accident occurred last week on Route 61 when rescue teams responded to the emergency and found the man trapped. The crews were able to extricate the man and transport him to the hospital within 30 minutes.
The identity of the victim has not been announced and a full investigation into the accident is underway. It is unknown at this time what caused the machinery to fall onto the man.

AIG may pay $146 million after workers’ comp lawsuit

The American Insurance Group Inc. and other insurance affiliates have agreed to pay nearly $146 million after claims were made that they violated workers compensation regulations.
Nearly $100 million of the settlement is due to fines and the other $46 million are additional taxes and assessments. The lawsuit came about after state regulators accused AIG of reporting workers compensation as general commercial automobile liability premiums.
The insurance giant then under-reported $2.12 billion in workers compensation premiums. The company must file restated financial statements and submit to periodic monitoring.

OSHA tells retailers for crowd management on Black Friday

The Occupational Safety and Health Administration sent letter to 14 retailers that explained the importance of having a plan for crowd control on ‘Black Friday.’
Black Friday is the day after Thanksgiving and is one of the biggest shopping days of the year. Huge sales are placed on items which causes the stores to become very crowded. This day marks the beginning of holiday shopping. The reason for this letter from OSHA is the death of a Wal-Mart employee in 2008 on Black Friday.
A crowd of shoppers were waiting outside and when the doors opened they trampled the 34-year-old worker to his death. The letter strongly encourages the retailers to take extra precaution to prevent situations like this. A fact sheet on crowd management safety was also included in the letter.

Injured Metro-North worker awarded over $2M

A man that was injured while working in the Metro-North Railroad last year in New York has been awarded $2.6 million by the federal jury in his case.
The 42-year-old man was injured when he was shocked with 7,500 volts of electricity while performing maintenance on the track. The man sustained nerve damage and other injuries as a result of the accident. Metro-North has accepted negligence in the accident, but they plan to appeal the verdict in the case.

Oil and Gas industry considers suing OSHA

The oil and gas industry is weighing its legal options over what to do about a new federal policy that will require workers to wear flame resistant clothing on well-drilling rigs.
Industry leaders are considering fighting OSHA on this new rule because they feel that the new rule could cost the industry up to $50 million to put in place and over $100 million a year to keep active.
The new rules require that all workers in the oil and gas well-drilling, servicing and production-related industries must wear flame- resistant clothing to protect them in case a fire breaks out quickly.
OSHA created the new regulations from the statistics that show that 16 percent of deaths in the oil fields were due to flash fires. Industry leaders sent a letter to OSHA to express their concerns with the new regulations.
