Four workers injured in plant explosion

A Tennessee plant explosion left four workers injured. This is the third incident at the plant this year, in January, a worker was killed in an explosion and another accident occurred in March.

According to police, the accident occurred at the Hoeganaes Plant just after 6:30 a.m. on Friday. The plant makes metal powders that are used in industrial and automotive parts.

It is unclear at this time what the exact cause of the explosion was, but this is the third explosion this year. One worker has been killed and now five injured. The names of the victims have not been released at this time. Two of them were transported to Vanderbilt Medical Center in Nashville to be treated.

CDC report shows injuries in older workers’ continues to climb

Because more and more Americans are working until later ages in life, the number of workplace injuries for this age group continues to rise.

Americans are working over the age of 55, and the federal health report shows that the percentage of injuries in this age group has risen from 12 percent in 2003 to 17 percent.

Although older workers do not have an overall higher risk of injury over their younger co-workers, they are more susceptible for hip injuries from falls off of ladders and other heights. Workplaces must now be even more cautious about the safety of their older workers or the number of injuries will continue to mount, according to researchers with the Center of Disease Control.

Man trapped in pit after workplace accident

A Pennsylvania man was rescued nearly two hours after he became trapped in a pit full of loose gravel. The incident occurred at Clinton Block Co. when the man was working near the hole.

The 55-year-old man then went into the hole to unclog an auger when a stone collapsed on his lower body, trapping him inside. Employees that were nearby began to try and dig him out, but the stone continued to collapse.

Police were called about an hour after he became trapped and he was freed about an hour after emergency crews arrived at the scene. Emergency responders were worried that the man may suffer from crushed injury syndrome, which occurs when muscles begin to break down and it causes problems with the kidneys. The man was taken to Hunterdon Medical Center to be treated.

Company cited by OSHA for 31 violations

The U.S. Department of Labor’s Occupational Safety and Health Administration has announced that they have cited a company with 31 safety and health violations.

The company, SOLVE Composites, now faces up to $126,000 in fines after OSHA inspected the plant. The inspection was done after  an employee complained to the administration.

OSHA found that the company was not protecting workers against basic hazards that can occur in situations where combustible chemicals are near. Without the protection, employees could suffer serious injury or death from a fire or explosion.

New Pa. workers’ compensation bill to be heard this month

A bill in the Pennsylvania is scheduled to be heard on March 23 and will expand the workers’ compensation coverage to businesses that were previously ineligible.

The bill, HB 440, will expand the Workers’ Compensation Act so that insurers can cover those who are members of a limited liability corporation or partners in a business partnership. The bill has been called a “common sense” bill that many can see the advantages of. This bill will broaden coverage for employees and employers if someone is injured in an event at work.

Penn. Governor vetoes firefighter bill

The Governor of Pennsylvania has vetoed a bill that would expand the number of cancers that are associated with occupational diseases for state workers’ compensation programs.

The governor’s veto of the bill, HB 1231, was passed unanimously through the House and overwhelmingly in the Senate. The high costs to municipalities is the primary reason why the bill did not get passed.

The bill was estimated to cost local governments $360 million over a five-year-period. If the bill would have passed it would have provided medical coverage for firefighters that were diagnosed with cancer before they retired or within in five years.

AIG may pay $146 million after workers’ comp lawsuit

The American Insurance Group Inc. and other insurance affiliates have agreed to pay nearly $146 million after claims were made that they violated workers compensation regulations.

Nearly $100 million of the settlement is due to fines and the other $46 million are additional taxes and assessments. The lawsuit came about after state regulators accused AIG of reporting workers compensation as general commercial automobile liability premiums.

The insurance giant then under-reported $2.12 billion in workers compensation premiums. The company must file restated financial statements and submit to periodic monitoring.

Oil and Gas industry considers suing OSHA

The oil and gas industry is weighing its legal options over what to do about a new federal policy that will require workers to wear flame resistant clothing on well-drilling rigs.

Industry leaders are considering fighting OSHA on this new rule because they feel that the new rule could cost the industry up to $50 million to put in place and over $100 million a year to keep active.

The new rules require that all workers in the oil and gas well-drilling, servicing and production-related industries must wear flame- resistant clothing to protect them in case a fire breaks out quickly.

OSHA created the new regulations from the statistics that show that 16 percent of deaths in the oil fields were due to flash fires. Industry leaders sent a letter to OSHA to express their concerns with the new regulations.

Police officer charged with workers compensation theft

A police officer in Waynesboro, Pa. has been arrested on charges of theft for allegedly stealing $22,000 worth of workers compensation checks.

The 31-year-old man was arraigned on Tuesday, but was released on a $15,000 bail. According to the criminal report, the man was injured on the job in August 2009 while on a pursuit. His hand, wrist, face and knee were all injured and he was referred to a hand specialist for treatment.

The man received workers compensation payments when the specialist suggested that he should not work during the initial surgery. According to a news release, the man was entitled to receive his regular salary as long as he signed over the workers compensation checks. The man only signed over three of the 22 checks that he received because he was still working full-time when he was injured.

Penn. court rules on preemployment workers compensation

The Pennsylvania Commonwealth Court affirmed the decision made by the Workers Compensation about an injury that occurred during the preemployment of a person.

The person filing the claim said that she had to take a tuberculin test before getting hired. She claimed that after she took the test, she felt faint and fell to the floor and was seeking payment of her medical bills. The board denied her claim because she was not an employee yet.

The board decided that even if the employer was to hire she was not an employee at the time of the incident so she was not entitled to the workers compensation benefits. The Commonwealth Court found that although the woman claimed that she was hired already, if she would have failed the tuberculin test, the compnay would not have hired her.
