Court rules contractor can not sue airline after accident

The California Supreme Court has announced that a worker that was injured while on a conveyor belt at the airport can not sue the airline.

The maintenance worker was hired as a contractor by the San Francisco International Airport when he injured his arm while working on the US Airways baggage conveyor belt and his arm got stuck. The lawsuit stated that this event caused him to suffer career-ending injuries.

The court decided that since the man was an independent contractor, US Airways did not have responsibility for the worker and that the contractor’s employer was responsible for him.

Woman sues over long term disability payments

A woman who suffered a brain injury is suing a life insurance company after they allegedly wrongly denied her long term disability payments.

The woman’s suit claims that Unum Life Insurance Co. dragged out the investigation on her claims and made unreasonable demands for her. The woman suffers from short term memory loss and has been disabled since June 19, 2001.

She had been receiving Social Security Disability payments. The woman had also been receiving short term and long term disability payments as part of a compensation from an employer.

In February 2002, the suit claims that the insurance company denied the woman long term disability although they previously approved short term disability. She is asking for the payments of benefits with interest from date of eligibility to date of judgment.

OSHA releases site inspection plan

The Occupational Safety and Health Administration has released its Site-Specific Targeting plan for 2010. This plan is to help the agency enforce safety requirements in high-hazard jobs.

The SST program is for non-construction workplaces with over 40 workers. These establishments are then selected at random to be inspected. The plan focuses on several variables such as the number of injury and illness cases, the number of days of work missed due to injury and the number of job transfers that occurred after a workplace injury. The goal of the program is to help employers prevent injury at work and to save lives.

N.J. worker injured in on site electric accident

A New Jersey man who is a contractor for Hawkeye LLC was injured on the job in Salem County.

A spokesperson from Atlantic City Electric has announced that there was an injury but details have not been released and the cause of the accident is currently under investigation.

The current condition of the man is also unknown, but he was transported to the hospital by helicopter when the accident occurred.

Disability services squeezed in Pennsylvania

Nearly 18,000 people statewide in Pennsylvania are waiting for community-based mental retardation services. Of those waiting, over 3,000 are considered to have emergency needs, meaning that they will have to move to a state institution if they can not gain access to the services.

Gov. Ed Rendell proposed an increase in the community metal retardation waiver program services. The program provides services such as home and vehicle accessibility adaptions, educational support, transportation, and nursing. According to the Department of Public Welfare, this program helps about 24,500 people.

Lawmakers and advocates feel that the increase in the budget was not enough to help even more people because the increase in the budget will only help another 150 people. The program is mostly federally funded but received $623 miliion in state money this year.
