Injured Metro-North worker awarded over $2M

A man that was injured while working in the Metro-North Railroad last year in New York has been awarded $2.6 million by the federalĀ  jury in his case.

The 42-year-old man was injured when he was shocked with 7,500 volts of electricity while performing maintenance on the track. The man sustained nerve damage and other injuries as a result of the accident. Metro-North has accepted negligence in the accident, but they plan to appeal the verdict in the case.

Oil and Gas industry considers suing OSHA

The oil and gas industry is weighing its legal options over what to do about a new federal policy that will require workers to wear flame resistant clothing on well-drilling rigs.

Industry leaders are considering fighting OSHA on this new rule because they feel that the new rule could cost the industry up to $50 million to put in place and over $100 million a year to keep active.

The new rules require that all workers in the oil and gas well-drilling, servicing and production-related industries must wear flame- resistant clothing to protect them in case a fire breaks out quickly.

OSHA created the new regulations from the statistics that show that 16 percent of deaths in the oil fields were due to flash fires. Industry leaders sent a letter to OSHA to express their concerns with the new regulations.

Worker falls while working inside Pennsylvania campus building

A electrician working in a Pennsylvania campus building managed to escape serious injury as he fell in between floors while working on a the building that was under construction.

According to officials, the man was a contract electrician who was working on the fifth floor of the building when he slipped while working and fell between two air handlers. The incident occurred at Penn. Medicine’s “Translational Research Center.” Rescue crews arrives at the scene in order to free the man from the confined space that he had fallen into.

Crews attached a harness to the man and used a machine to pull him out of the space. He was then taken to the hospital at the University of Pennsylvania to be treated for non-life threatening injuries.

Penn. court rules on preemployment workers compensation

The Pennsylvania Commonwealth Court affirmed the decision made by the Workers Compensation about an injury that occurred during the preemployment of a person.

The person filing the claim said that she had to take a tuberculin test before getting hired. She claimed that after she took the test, she felt faint and fell to the floor and was seeking payment of her medical bills. The board denied her claim because she was not an employee yet.

The board decided that even if the employer was to hire she was not an employee at the time of the incident so she was not entitled to the workers compensation benefits. The Commonwealth Court found that although the woman claimed that she was hired already, if she would have failed the tuberculin test, the compnay would not have hired her.

OSHA penalizes New York Kosher salad company

Two federal agencies have sent warnings to a New York Kosher food maker, Sally Sherman Foods, so that they can correct dangerous hazards in their facility in Mount Vernon.

The U.S. Federal Drug Administration sent a warning letter and the Occupational Safety and Health Administration has fined the company $247,000 for the dangerous working conditions in the plant. Since November 2009, OSHA officials have been trying to get the plant to get appropriate fall protection standards for the workers..

Also, the company needed to work on guarding their machines and controlling hazardous energy. The FDA said that their food products are held in unsanitary conditions. Both federal agencies are giving the company 15 days to respond to the violations.

Two people killed in natural gas explosion

Two people were killed after a natural gas well exploded and caused a fire that lasted for hours. Welders were believed to be working at the site at the time of the accident.

The accident occurred north of Pittsburgh around 9:50 a.m. in a wooded area. Even after firefighters worked to get the fire under control, some areas still burned for almost three hours.

According to a spokeswoman at the Department of Environmental Protection, the cause of the explosion is unknown but it is believed that people were welding in the area when the well caught fire. It is also unknown at this time why people were welding there.

Explosions can cause serious injury to all involved, our thoughts are with the friends and family of the victims.

Board investigates pipe cleaning safety

After the blast in Conn., that killed six pipefitters, one of their widows has urged the safety board to look closely at the safety precautions and tighten the safety rules in the industry.

The widow asked a congressional subcommittee to consider banning the use of explosive gas to clean up the pipes.There has been two recent cases that have shed the light on the dangers of the industry.

In both cases, natural gas had accumulated while the workers were cleaning the pipes. Some say that this is used because it cost less money and is less time-consuming that other methods.

Pennsylvania printer fined by OSHA

A printer in Pennsylvania was fined $107,100 for allegedly violating safety rules set by the Occupational Safety and Health Administration.

The printing company, S.G. Printing of Wayward, Pa. was cited with 13 violations that were found by investigators from OSHA between April 2007 and January 2008. Four of the violations include are having alleged hazardous situations in the workplace.

Other citations are concerned with the plant’s conditions and working equipment such as sanitation, machine shut-off process, the training process of employees, and control of hazardous energy. Readers are unhappy with OSHA’s findings because they think that OSHA excessively watched the company.

OSHA to hold further meetings about on new preventions rule

The Occupational Safety and Health Administration will hold two additional meetings to discuss the new injury and illness prevention rule with stakeholders to ask for any further comments that they could implement while developing the program.

The new rule will be put into place so that workplace injury and illness will be reduced. The discussion meetings will address workplace safety and health hazards that can arise in the workplace. There will be one meeting in Washington D.C. and one meeting in Sacramento. Anyone who is interested in attending the meeting must send a notice to OSHA before the deadline.

Workers compensation recieved for injury during on call towing job

A claimant filed a workers’ compensation suit claiming that he was injured on the job and should receive workers compensation benefits. The determining factor was if the person was actually engaged in the furtherance of an employers business.

The person was working part-time towing and doing other jobs for their employer. Even if he was off the clock, he was on-call as a tow truck operator. While the man was on call he accepted a towing job and slipped and fell on ice while walking to his vehicle. As a result of the fall, he had to have surgery on his spinal cord. His claim was granted and the Pennsylvania Workers Compensation Appeal Board upheld the request.
