What can I do if I have been unfairly denied benefits?
In most cases, the first step is to take the matter up with your employer or their workers’ compensation insurance provider. Sometimes the problem is just a misunderstanding or small error that can be cleared up. If the problem persists, you have three years from your date of injury to file a Claim Petition.
Eventually, you may end up meeting with a workers’ compensation judge, along with representatives of your employer or their insurance provider. At this hearing, the judge will issue a decision about your eligibility for compensation. If you still disagree, you can appeal this decision with the Workers’ Compensation Appeal Board, then the Commonwealth Court.
